Two people died on a busy San Jose freeway on December 2, 2025, trapped in a burning car while strangers tried and failed to save them. About seven months later, the man prosecutors say caused that fire faces two counts of murder. A critical bail hearing on September 18 will determine whether he walks out of custody while the case moves toward trial.
The Crash and the Charges
Prosecutors say Chernicky drove his Tesla at more than double the speed limit before slamming into stopped traffic and igniting a deadly fireball.
Around 10:40–10:50 a.m. on December 2, 2025, Zachary Steven Chernicky, 31, of San Jose, allegedly drove his red Tesla Model Y northbound on Highway 87 near Curtner Avenue at speeds reaching 142 mph. That is more than double the posted 65 mph limit, according to prosecutors. Vehicle data cited in court filings indicates he was still traveling approximately 102 mph when he rear-ended a Lexus SUV that had stopped in heavy morning traffic. The Lexus ignited instantly.
Witnesses reported the Tesla driving recklessly before the collision, possibly racing a BMW northbound through congested lanes, according to court documents as reported by KRON4. Ivana Balistreri, 29 years old, and her 1-year-old daughter Lilliana were on the passenger side of the Lexus. Her fiancé, Zachary Martins, and other motorists tried to pull them free, but flames and ongoing explosions drove them back.
Prosecutors say Chernicky walked away from the crash with scratches on his knees, watched from the side of the road, and scrolled through his phone while Martins screamed for help.
Santa Clara County District Attorney Jeff Rosen framed the legal theory directly, according to CBS News San Francisco: “The law says that it is murder when someone shoots into a crowd. When someone is driving 140 mph, then the driver is the shooter and their car is the bullet.” Chernicky was arrested following a months-long California Highway Patrol investigation and has not yet entered a plea.
After the Crash: Social Media and the Bail Fight
Prosecutors argue that Chernicky’s Instagram posts and potential relocation plans mark him as both unremorseful and a flight risk.
Within 24 hours of the collision, Chernicky posted a photo of the crash scene on Instagram with a caption focused on his own survival and the destruction of his Tesla, with no mention of the victims, according to Deputy District Attorney Marisa McKeown’s motion as reported by KRON4. Prosecutors argue he “posted about it like he was a victim.”
Before his July 2026 arrest, Chernicky obtained another Tesla. He continued posting videos of himself driving fast in Teslas and sports cars on Instagram, according to court records cited by KRON4. Court filings also reference posts in which he mentioned potential plans to relocate to Florida or take a job in Paris, which prosecutors present as evidence of flight risk.
McKeown told ABC7 that “we believe that this defendant is uniquely dangerous.” The September 18 bail hearing before Judge Hector Ramon at the Santa Clara County Hall of Justice is the immediate flashpoint. Chernicky’s defense attorney is seeking release pending trial; prosecutors are fighting to keep him in custody. Dozens of letters from the Balistreri family have been submitted to the judge opposing bail.
In one of those letters, summarized by KRON4, Ivana’s father asked the court: “What type of person drives over 140 miles per hour on a highway that is always busy?” A separate family member wrote: “He killed my family members. I believe he is a threat to this community, and deserves to remain in custody.” Judge Ramon’s decision on September 18 will determine whether Chernicky faces the remainder of this case from a jail cell or from the outside, as prosecutors prepare to take a murder case to trial over a crash that took a mother and her daughter in seconds.
